BREAKING: "Prove It Was Him" – SDA Evangelist Marufu Walks Free as State Demands Meta (Facebook) Report

The high-profile cyberbullying case against prominent Seventh-Day Adventist (SDA) Evangelist Sam (Simbarashe) Marufu has taken a dramatic legal twist. Yesterday, Marufu walked out of the Harare Magistrates Court a free man after prosecutors refused to hear the matter, dealing a severe blow to the three female churchmates accusing him of public humiliation.

THE BURDEN OF PROOF: SDA Evangelist Sam Marufu has challenged the State to legally prove that he was the individual who operated the Facebook account that mocked his female congregants.

Represented by top Harare lawyer Admire Rubaya, the defense successfully challenged the prosecution to prove beyond reasonable doubt that the evangelist is the actual owner of the Facebook page in question, and the person who hit "post." The State has now referred the case back to the police, demanding a formal digital forensics report from Meta (the parent company of Facebook) before proceeding.

The Burden of Digital Proof

The prosecution has hit a legal roadblock, highlighting the complexities of prosecuting cybercrimes in Zimbabwe.

Despite public outrage and an alleged earlier apology, Marufu's legal team is demanding hard evidence.

Walking Free Several contentious issues were raised by lawyer Admire Rubaya, stalling the start of the court case. Prosecutors ultimately declined to take the matter into court, resulting in Marufu walking out of the Harare Magistrates Court a free man while investigations are forced back to square one.

The State has refused to prosecute based on screenshots alone.

Tracking the IP Address Prosecutors now want the police to secure a formal report from Facebook owners, Meta, confirming that the account which carried the contentious claims legally belongs to Evangelist Marufu. The report must also prove that he was the individual physically operating the device when the offending statements were published.

The Video and The Backlash

The three female congregants—Rotina Mafume Musara, Alasia Mbiriri, and Perseverance Muzeya—remain resolute in their pursuit of justice.

From Preaching Prep to Public Mockery The three SDA church members had innocently recorded a video of themselves preparing to preach. They claim this video was subsequently hijacked, downloaded, and shared onto the Evangelist’s social media page to garner online "likes" through public humiliation.
"When Shepherds Have Become Wolves" The offending post was shared with a highly inflammatory caption reading: "When shepherds have become wolves you, (the) pastor’s wife, your husband has been exposed… for a woman is the glory of man. Muchavaziva nezvibereko zvavo (You shall know them by their fruits)." The post attracted a barrage of negative comments targeting the women.

ZRP's Forensics Challenge

With the case thrown back to the investigative phase, the Zimbabwe Republic Police face the complex task of digital forensic mapping.

The police already have the physical device, but need the digital footprint to match.

Device Confiscated Following the formal police report filed at Marlborough Police Station (RRB 6875200), Harare provincial police spokesperson Inspector Luckmore Chakanza confirmed: “His cellphone, which he used, is now in the hands of police as investigations continue.” The device will likely undergo forensic extraction to satisfy the prosecutor's demands for Meta authentication.
The Retracted Apology? Before his court appearance, Marufu had reportedly consulted his lawyer and issued an apology online: "Sincere apologies to those who felt insulted or offended by my post..." However, in a court of law, establishing absolute digital identity requires more than an online apology, leading to the current legal stalemate.
